I read that as simply "website owners must confirm that pornographic/nude images depict people over the age of 18". Doesn't that mean that as long as the depicted has been confirmed, it's ok to post it? This also goes for posting nude anime content; according to the federal law, it's fine if you have hentai or ecchi or whatever, since it's not kiddie porn in that sense, no matter what is depicted.

Of course, the BBS rule covers most of that, but nude photos seem to be completely ok as long as they follow the federal guidelines...

Since NG allows down to the age of 13 (And obviously unofficially younger) then I see a good point in controling the crap that's here.

If the authorities were to catch you with an image which breaks these rules but you deleted it very soon after could you still be prosecuted?

We can post nude images as long as we have ON RECORD all ther personal information about the people in the pictures. No records, no nude images. It's that simple. So for a user to submit a nude photo to the BBS they would have to provide us with all the personal information of the nude people in the picture and we would have to keep it on file. We would also have to have an office that's open a minimum of 20 hours a week that the feds could come to if they wanted to review our records.

I dunno. Most likely this law will only be used to after the serious offenders. We probably wouldn't show up on their radar or be investigated, but we also don't want to put ourselves at an any un-neccessary risks.

This law effectively lowers the rate of porn sharing because not everyone can have a 20 hour office for the feds to visit. I mean as much as I am old enough to go buy porn, I still don't like this.

This law may change, but if it's allowed to stand it will land a hard blow to the entire porn industry.

Think about this. You are a porn star. Now in order for you to conitnue working you have to provide your personal information, your home address, age, phone #, maybe social security number, etc to the people producing the porn images. Then these producers may have to send these records to anyone they sell the porn images to that wants to also display them on their website, sell the videos, etc. A video rental store may have to keep these records on file to rent out the videos, or sell them. Website owners would need to keep the records, or know where to find them, to host the images.

So now if you're a porn actor, model, whatever, you have to worry about your personal information in the hands of an untold number of people. How many people do you think would quit the porn industry? Also how many distributors of porn would shut down and not bother with it anymore?

That's what this law is designed to do, make it such a burden and pain in the ass to conduct business in the porn industry that many will stop.

Yup. 2257 effects all websites in the USA. Unless you have records proving the person is over 18, and lists their address, phone #, etc, you can't have the image there without risk of breaking the law.

It won't be quite that extensive. I read parts of the law. It states:
"The statute requires producers of sexually explicit matter to maintain certain records concerning the performers to assist in monitoring the industry...

The statute defines ``produces'' as ``to produce, manufacture, or publish any book, magazine, periodical, film, video tape, computer-generated image, digital image, or picture, or other similar matter and includes the duplication, reproduction, or reissuing of any such matter, but does not include mere distribution or any other activity which does not involve hiring, contracting for[,] managing, or otherwise arranging for the participation of the performers depicted.'' 18 U.S.C. 2257(h)(3)."

So that means porn stores and the like won't have to have all that information, but only the people producing the porn.
