Yes, the Spam category is a little esoteric sometimes. In this case it would be stolen because they stole every aspect of the video. They took it from elsewhere. That's stolen. Whenever the content is taken from elsewhere, stolen. Spam is more things like videos that are just ads for someone's website and things like that. One time we had an ad for a Chinese clothes hanger company or something. If someone reuploads a submission that was blammed before without making any changes, that's spam. Same goes for releasing a bunch of 0-effort submissions in a very short time with the intent of spamming.
Would my flag be ignored if put int he wrong category? Would my whistle status go down if I flagged the category differently the what the community generally flagged it as?.
Nope, what's important is the report you give to justify the flag. Also, mods will often clear flags with no consequences for the submission or the flagger if the flag was wrong but not meant to hurt the submission, the creator or spam the mods.
my flag description of this video went something like this:
"This submission is just a exact (albeit low quality) rip of the Halo 3: Believe commercial. A copy of the original commercial can be found on the official (check marked) Bungie Studio Youtube channel:

I report this because I don't see why everyone doesn't just re-upload exact copies of commercials just to say they are 'creating content' for views. I'm not sure of the reporting system methodology on whether this falls under the 'Stolen' Flag category, or the 'Spam> pirated video' category but it is not original content. If this was someone who was involved in the making of video as the part of some reel I think they would give more information about the fact that they had a hand in making it. And as a continued copyrighted property even then I don't think they would have the right to post it."

Damn dude, that is a long report. They don't have to be long, generally the mods know what you're talking about.
I am also uncertain if I have the right to post here since I see there seems to be some sort of criteria, So I keep my postings minimal. But the official Newgrounds user wiki directs to this forum for questions about flagging so I am still unsure on that.
The criteria are for actually joining the Barracks, but anyone can post here, and is encouraged to do so, as it helps clean up the site. So when you see something flag-worthy in the movie or game portal, report it here, same if you're unsure about something. In time, if you're active and that's what you wanna do, you can meet the criteria and join as an official member.
