Afaik there's only an issue with using Nintendo sprites in games - animations usually get a pass.

I haven't been able to dig out a fresh copy of Flash 8, but I've seen this before. My brain is telling me strongly that this was one of the Flash 8 internal tutorials, assets and all.

I can't confirm it hard enough to hit the flag though.
