Also, an art reference is something you take guidance or inspiration from, generally intended to be worked upon with the copiers personal styles or touches where the resulting piece has enough deviation from the original to stand on its own, unless for practice or as a homage or pastiche, not traced over wholesale which is the case here.

So then you're not actually sorry if you're accusing him of tracing over an original artwork, which you can't prove. Maybe he has good eye for detail as he's drawing off a reference, ever thought of that? If he decides to draw from a reference, then he's clear from "stealing/tracing" and is only drawing with his own capabilities of detail, lines, etc
Drawing from references is perfectly fine and normal
