A good friend of mine (Tyler, Doodlebin) thought up both the idea, and created most of the art for the game. They never really finished it off, and now Mike took his art and idea, finished it and put it on flashgamelicense to sell it. He sold it without giving my friend:
1. Any notice of finishing the game.
2. Any kind of credit in game
3. Any money he got from the sponsorship.

AND NOW HE'S GOT A JOB OFFER FOR THIS TREACHEROUSNESS?

Everyone here needs to realise this nothing but ordinary theft.

As much as I'm hurted and disgraced that my word isn't enough, and a serious case like this gets disregarded by the lack of physical proof. Yes I do:

As you can see there's more (in the same style) art then is stolen and used in the game. Also some small changed have been made to it.

Really none of my business, but if the artist agreed to a commitment and bailed then that's basically akin to stealing in itself. Except you aren't stealing artwork you are stealing the programmers time & effort.

At the same time had the programmer made money off the project without sharing some money then that seems equally unfair. How are they to agree on a fair payment if the artist only completed part of his job.

My thought on the matter is thus. If the project completely broke down then that's it. Dependant on the terms written up in the agreement (and if you didn't write anything up, well shucks...) the artist and programmer are perfectly free to cannibalise and recycle the project.

Having not actually seen the finished product or the works in progress (literally stumbled back here) can't really judge if mike has ripped the guy off completely, or whether it's simply a case of patching up a few holes and releasing the project as it was. But if the artist wants beef, I'm sure he has mike's number, and doesn't need someone protecting him on a forum.

After all. Nothing was really stopping the artist from finishing the game at HIS end either and doing exactly the same thing... okay missing source files maybe but that again is down to mismanagment and not keeping hold of what you're working on.

Trust in these things are good, but always remember your partner may get lazy, may be unprofessional, may vanish, may die, may sue, and may simply just plain drop out. These things, sadly enough, need to be discussed at the setup stage of a collaberation because when real money ends up on the line, or potentially ends up on the line, things get ugly when they break down...

I guess I did overreact a little, but shit like this needs to be said out in public. Maybe Mike screws over another 3 artists if I ( or the artist himself for that matter ) wouldn't have done anything. Now I'm guessing he's learned his lesson, and from what I'm hearing everything is sorted out between the 2 of 'm.

I'm by no means trying to imply that Mike is a bad person. What he did was wrong, but his (your if you're Mike) explanation seems legit.

Also I don't think this is a matter to pick sides on, it's just something to learn from. We basically all have agreed that it's better to make clear agreements beforehand. This is the perfect example of what could happen otherwise.
